Terms of Service

These terms govern your use of Ekklesia, operated by Nylank Technologies. Please read them before creating an account or using the platform.

Please read carefully. These Terms of Service govern your use of the Ekklesia platform operated by Nylank Technologies. By using the platform you agree to these terms.

1. Acceptance of Terms

By creating an account or using the Ekklesia platform ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

These Terms constitute a binding agreement between you (the church organisation or individual user) and Nylank Technologies, the operator of Ekklesia.

2. Description of Service

Ekklesia is a SaaS church management platform providing tools for member management, event scheduling, finance tracking, communications, and analytics. The Service is provided as-is via web browser and Progressive Web App (PWA).

Nylank Technologies reserves the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice to registered users.

3. Eligibility

You must be at least 18 years old and have the authority to enter into binding agreements on behalf of your church organisation to use Ekklesia. By registering, you represent and warrant that these conditions are met.

4. Account Registration

To use Ekklesia, you must create an account by providing accurate and complete information. You are responsible for:

Maintaining the confidentiality of your account credentials.

All activities that occur under your account.

Promptly notifying us of any unauthorised use of your account at hello@ekklesia.app.

You may not share account access credentials with persons outside your organisation.

5. Pilot Programme Terms

During the pilot programme, Ekklesia is offered free of charge to selected church organisations. Pilot participants acknowledge:

The platform is in active development and functionality may change.

Service levels and uptime guarantees do not apply during the pilot period.

We may collect enhanced usage feedback to improve the product.

Transition to a paid subscription plan will be offered with reasonable advance notice when public billing launches.

6. Subscription & Billing

Paid subscription tiers (Starter, Growth, Enterprise) will be available when public billing launches. When applicable:

Subscriptions are billed in advance on a monthly or annual basis.

Prices are as listed on the Pricing page and may be updated with 30 days' notice to existing subscribers.

You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

Refunds are not issued for partial billing periods unless required by law.

7. Acceptable Use

You agree to use Ekklesia only for lawful purposes and in accordance with our Acceptable Use Policy. You must not:

Use the Service for any illegal, harmful, or fraudulent activity.

Upload or distribute malware, viruses, or harmful code.

Attempt to gain unauthorised access to the platform or other users' accounts.

Circumvent or disable any security features of the Service.

Use the Service to send unsolicited bulk communications (spam).

Violation of the Acceptable Use Policy may result in immediate account suspension or termination.

8. Data Ownership & Privacy

You retain full ownership of all church member data and other content you input into the platform. By using Ekklesia, you grant Nylank Technologies a limited, non-exclusive licence to process your data solely to provide the Service.

Nylank Technologies processes data in accordance with our Privacy Policy. We do not sell church member data to third parties.

9. Intellectual Property

The Ekklesia platform, including all software, designs, text, and content created by Nylank Technologies, is protected by intellectual property law and remains the exclusive property of Nylank Technologies.

Nothing in these Terms grants you any right to use Ekklesia's trademarks, logos, or branding without prior written consent.

10. Service Availability

We strive for high availability but do not guarantee uninterrupted access to the Service. Planned maintenance will be communicated in advance where possible. Enterprise plan customers are eligible for SLA commitments as specified in their agreement.

11. Limitation of Liability

To the fullest extent permitted by law, Nylank Technologies shall not be liable for:

Indirect, incidental, special, or consequential damages.

Loss of data, revenue, or business arising from use of the Service.

Service interruptions beyond our reasonable control.

Our total aggregate liability to you shall not exceed the fees paid by you in the 12 months prior to the claim.

12. Indemnification

You agree to indemnify and hold harmless Nylank Technologies and its officers, directors, and employees from any claims, damages, or expenses arising from:

Your use of the Service.

Your violation of these Terms.

Your violation of any third-party rights.

13. Termination

Either party may terminate an account at any time. Upon termination:

Your access to the Service will cease immediately.

Your data will be retained for 30 days to allow export, then permanently deleted.

Outstanding subscription fees remain due.

We may suspend or terminate accounts that violate these Terms without prior notice.

14. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved in the competent courts of Nigeria, subject to any applicable international treaties.

15. Changes to These Terms

We may update these Terms from time to time. We will provide at least 14 days' notice of material changes via email or in-platform notification. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
